The Pharmacy Benefits Manager, Express Scripts, has filed a motion to move a class-action lawsuit out of Cambria County, and into federal court. WJAC News is reporting that the law firm that is representing around 300 customers of Martella’s Pharmacy against Express Scripts, says the motion was filed yesterday. Recently, a judge in the Cambria County court of common pleas ordered an injunction that prevented Express Scripts from terminating Martella’s Pharmacy from their network. That termination was to have kicked in last Friday. Reportedly, if the case does move to federal court, the injunction would be dissolved, and customers would immediately lose access to Martella’s Pharmacy prescriptions. Other pharmacies in Cambria County are also affected by this move from Express Scripts, and they include Boswell Prescription Center, Penn Laurel Pharmacy, and Ligonier Pharmacy. The law firm representing Martella’s reportedly plans on filing a motion to keep the case in Cambria County.
