The Altoona Mirror reports that the trial for Darwin Herring, which was to have begun today in court, has been pushed back so his new attorney can review the case. Herring is facing charges of aggravated assault, reckless endangerment for throwing a water pitcher across a courtroom last October and endangering Judge Jackie Bernard. The incident also broke a television set in the courtroom. Judge Tim Sullivan has taken over the case, since Judge Bernard can be called as a witness. Herring says he has a new lawyer after turning down the advice if his previous counsel to take a plea deal, which would have added time to his current 25-177 year sentence for drug trafficking.
