Prison sentence upheld

The Altoona Mirror reports that a panel of judges upheld the sentence for Kristopher Gardner now of Pittsburgh. Gardner was sentenced last year in Huntingdon County for defrauding two homeowners for work he never finished. He was given money by the homeowners for materials. The state superior court upheld his original sentence of 8 1/2 to 17 years in prison. Gardner told the court he would make restitution to the victims but never came up with the money. Gardner made his appeal, saying that his sentence was excessive, and that upgrading the charges at trial was a violation of his rights to a fair trial, but the superior court panel didn’t agree. Gardner is serving his time at SCI Rockview.
