Hershey is the winner of a lawsuit claiming its Reese’s Halloween candies aren’t spooky enough. The class-action lawsuit accused the company of false advertising because its Jack-o’-Lantern Reese’s Cups don’t have a face, but the packaging for the product depicts a grinning pumpkin. The consumers claimed they were “disappointed” when they unwrapped the treat. But a U.S. district judge ruled the lawsuit failed to prove that there was any economic injury.
