PA No Longer Allowed To Throw Out Mail Ballots Over Date Errors

Yesterday, a federal appeals court ruled that it’s unconstitutional for the state of Pennsylvania to throw out mail-in ballots because the voter didn’t write the correct date on the return envelope.  In an unanimous decision, the 3rd U.S. Circuit Court of Appeals ordered the commonwealth to stop throwing out such ballots.  Democratic Governor Josh Shapiro supported the lawsuit against the provision calling it unconstitutional.  His administration’s lawyers had argued that “meaningless errors shouldn’t cost you the right to vote in Pennsylvania’” he said.    Yesterday’s decision was a victory for the groups that sued which included the American Federation of Teachers of Pennsylvania, and campaign arms of Democrats in the U.S. House and the U.S. Senate.  Opposing the lawsuit were both national and state Republican parties.
