Judge Stops Clearfield Borough’s Exit From Regional Police

wrta-logo-sm

A judge has halted Clearfield Borough’s attempt to withdraw from the Clearfield Regional Police Department following a court ruling yesterday.  The injunction, issued in response to a lawsuit by Lawrence Township and the Regional Police Commission, mandates that the borough remain in the regional agreement and maintain its scheduled payments while litigation continues.  The plaintiffs argue that the borough violated the charter agreement by failing to provide a one-year notice, and settle financial obligations before attempting to exit.  Police solicitor Daniel J. Nelson stated that the ruling prevents the borough’s immediate withdrawal, noting that the decision was heavily influenced by the potential risks to public safety if the department were dissolved by year-end.  Borough officials in Clearfield have said they don’t have the financial reserves to remain in the agreement.
