Search Ruled Unconstitutional But Some Evidence Allowed In Mangione Murder Case

A New York judge has ruled that while the initial search of Luigi Mangione’s backpack at McDonald’s on Plank Road in Altoona was unconstitutional, the alleged murder weapon found during a subsequent station-house inventory search is admissible in his upcoming state murder trial.  Judge Gregory Carro suppressed evidence from the restaurant search—including a passport and magazine—but deemed the later discovery of a handgun lawful.  Mangione, accused of killing UnitedHealthcare CEO Brian Thompson, remains in federal custody, with his state trial scheduled for September.
